The Terms & Conditions –as defined below- apply to our services, directly or indirectly made available to you through whatever means, including online purchases, customer service requests or otherwise. By accessing, browsing and using Skyfleet Ltd website, you acknowledge and agree having read, understood and agreed to our Terms & Conditions.

1. Terms of Sale

Bookings made through Skyfleet Ltd website are subject to the terms below:

1.1

The period of our daily rental rates are valid for 24 hours. Exceeding this delay, an additional one day rental rate will be applied.

1.2

All prices are listed in Euro or any other designated currency and is inclusive of VAT at the applicable rate at the time of your order.

1.3

The user will be required to read and accept the terms and conditions which are displayed on our website before making a purchase. Once the purchase has been made, the user and merchant will be bound by such terms and conditions and both parties will receive a purchase confirmation email.

1.4

Skyfleet Ltd does not guarantee against pricing errors or issues with regards to programming and reserves the right, at its sole discretion, to not process or to cancel any orders placed for a product or service whose price was incorrectly posted or issues with programming that results in an error. If this occurs, Skyfleet Ltd will notify you by email and or by phone and a full refund will be given. In addition, Skyfleet Ltd reserves the right, at its sole discretion, to correct any error in vehicle / model availability.

1.5

Skyfleet Ltd may, in its sole discretion, verify a user’s identity prior to processing a purchase. In addition we may also refuse to process, or may cancel, a purchase, as reasonably deemed necessary to comply with applicable law or to respond to cases of misrepresentation, fraud or known or potential violations of the law or these Terms of Use.

1.6

Condition of Use

1.6.1

It is understood that the vehicle shall be used in full compliance of the road regulations in Mauritius. The company shall deliver the vehicle in good running conditions and an inspection sheet shall be duly signed by both parties. The signed inspection sheet by the client and Skyfleet designated representative shall be used as reference to the condition of the vehicle, items and accessories and shall be binding in case of dispute.

1.7

Accidents and Damage

1.7.1

Skyfleet reserves the right to charge the client a security deposit (usually equivalent to the insurance policy excess) before releasing the vehicle. Once the vehicle is returned, as long as there was no loss or damage to the vehicle and no additional charges for fuel replacement or late return, the security deposit will be refunded in full in the same manner in which it was charged.

In case of accident, the client will bear the cost of the insurance policy excess. In case of the vehicle was driven unlawfully and that the insurance does not entertain such claims, the client be shall solely responsible for any damages/claims arising thereof.

1.7.2

Loss or damage to the vehicle/its equipment /accessories including but not limited to wheel jack, tools, antenna, wipers and any damages arising from the negligence of the client or its designated representatives will be charged to the client.

1.7.3

In case of accident, the client shall at all times comply with the road traffic regulation of Mauritius including reporting to the concerned authority where required.

1.7.4

The Client shall immediately notify the company about any faults, anomalies or issues noted on the vehicle. Upon being notified the company shall indicate to the client the appropriate course of action.

1.8

Other Provisions

1.8.1

Fuel cost will be borne by client

1.8.2

The client shall be solely liable for any driving offences established against them or its designated representatives.

1.8.3

The client or its designated representatives is prohibited from driving the hired vehicle under the influence of alcohol, drugs, medicines or other substances which can have an perception and ability ,or allows such an effected person to operate the motor vehicles

2. Payment

2.1

Payment can only be valid if effected by Credit Card (i.e. Visa card or Master Card)

2.2

Under no circumstances will Skyfleet Ltd be liable for any kind of commission that your bank might charge you.

2.3

You guarantee that the credit card details are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost.

2.4

After placing your order, your credit card shall automatically be debited with the full amount due upon logging out of your account.

2.5

Once payment is cleared, you will receive an automated confirmation email of your order.

3. Booking Confirmation

Once you have made the payment, a booking confirmation will be made by e-mail. It is your duty to provide us with an accurate email address. If you do not receive a confirmation e-mail, you should contact our Reservations department at booking@skyfleet.mu.

Our booking confirmation e-mail will serve as proof of valid purchase and will contain relevant information about the hiring of car or services concerned. Please read and check carefully all the information contained in your booking confirmation e-mail to ensure that it conforms to your reservation. If there are any discrepancies to the details, we request that you inform booking@skyfleet.mu immediately by phone or by contacting our reservation department that is open Monday-Friday from 9am to 16pm.

You are required to produce your Reservation Confirmation to our designated company representative as well as valid driving license and passport. Please note that identification of the person whose name is on the purchase must be provided when hiring a car or other services.

4. Cancellation Policy

4.1

All booking can be cancelled by phone on 5-444-9988 or by email (booking@skyfleet.mu) before the start of the rental period. However Skyfleet applies a cancellation/ No show policy on all bookings as follows:

  • If cancellation is done more than 48 hours before the start of the rental period a full refund will be done.
  • If the cancellation is done less than 48 hours before the start of the rental period, a refund of 75% of the amount already paid will be applied.
  • If cancellation is done less than 4hours before the rental period a refund 50 % of the amount paid will be done
  • If cancellation/modification is done after the rental period has started, no refund will be done.

No show policy:

  • No refund will be done if there is a no show status from the client.

5. Data Protection and Privacy Policy

Visitors can make the purchase in a highly-secure environment without any fear due to the fact that the site is designed in a way that none of the payment information of the customers is stored. In addition we offer protection as Skyfleet Ltd does not collect any of your credit card information as all payments are processed by Mauritius Commercial Bank (MCB) and their online payment gateway. Skyfleet Ltd will never have access to your credit card details and no one can access your details through our secure online store.

5.1

By ordering from us, you consent to us collecting, recording and processing your personal data to process your orders, improve our service to you and to inform you of promotions and special offers. All data is collected lawfully, in accordance with the Data Protection Act 2004.

5.2

We will only send you information on promotions and special offers with your permission.

5.3

Links to third part websites & advertisements

5.3.1

The Site contains links to websites maintained by other parties. These links are provided solely as a convenience to you and not because we endorse or have an opinion about the contents on such websites. We expressly disclaim any representations regarding the content or accuracy of materials on such websites or the privacy practices of those websites. If you decide to access websites maintained by other parties, you do so at your own risk

6. Access to the Site

Skyfleet Ltd retains the right at our sole discretion to deny service, or access to the Site or an account to anyone, at any time and for any reason. You acknowledge that there may be interruptions in service or events that are beyond our control. While we use reasonable efforts to keep the Site accessible, the Site may be unavailable from time to time for any reasons such as routine maintenance. You understand and acknowledge that due to circumstances both within and outside of our control, Site access may be interrupted, suspended or terminated.

7. Modification of this Agreement

We reserve the right at all times to discontinue or modify any part of this Agreement as we deem necessary or desirable. If we make changes that materially affect your use of the Site or our services we will notify you by sending you an email to the email address that is registered with your account and/or by posting notice of the change on the Site. These changes will be effective immediately for new and existing users of Skyfleet Ltd and for all confirmed booking after the effective date of the change. Your use of the site after we update these Terms of Use will constitute acceptance of the modified Terms of Use.

We also reserve the right to change or discontinue any aspect or feature of our services or the Site including, but not limited to, requirements for access or use.

8. Disclaimer of Warranty.

YOU EXPRESSLY AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. NEITHER SKYFLEET LTD, DIRECTORS OR EMPLOYEES, WARRANT THAT USE OF THE SITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO (I) THE RESULTS THAT MAY BE OBTAINED FROM USE OF THIS SITE, OR (II) THE ACCURACY, COMPLETENESS, RELIABILITY OR CONTENT OF ANY INFORMATION (INCLUDING, BUT NOT LIMITED TO, PRODUCT DESCRIPTIONS, SERVICES, PRODUCTS, DEALS, OR STATEMENTS (AS DEFINED ABOVE) PROVIDED THROUGH THIS SITE. THE SITE AND ALL CONTENT, STATEMENTS AND OTHER INFORMATION CONTAINED ON THE SITE, AND PRODUCTS AND SERVICES ACCESSIBLE OR AVAILABLE THROUGH THE SITE ARE MADE ACCESSIBLE OR AVAILABLE ON AN “AS IS” AND “AS AVAILABLE” BASIS. SKYFLEET LTD HEREBY DISCLAIMS ANY AND ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE CONTENT, STATEMENTS OR OTHER INFORMATION CONTAINED ON THE SITE, OR THE PRODUCTS OR SERVICES ACCESSIBLE OR AVAILABLE THROUGH THE SITE, INCLUDING, BUT NOT LIMITED TO, THOSE OF TITLE NONINFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.

9. Limitation of Liability.

IN NO EVENT SHALL SKYFLEET LTD, DIRECTORS, EMPLOYEES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, THE CONTENT, STATEMENTS AND OTHER INFORMATION CONTAINED THEREIN, THE PRODUCTS OR SERVICES ACCESSIBLE OR AVAILABLE THROUGH THE SITE OR THESE TERMS OF USE. IN NO EVENT WILL SKYFLEET LTD ’S LIABILITY IN CONNECTION WITH A DEAL OR A PRODUCT OR SERVICE EXCEED THE AMOUNTS PAID FOR SUCH DEAL, PRODUCT OR SERVICE.

10. Applicable Law & Arbitration.

10.1

This Agreement shall be construed in accordance with and governed by the laws of Mauritius. The parties irrevocably consent to the exclusive jurisdiction of the Mauritian Courts for purposes of any proceedings relating to this Agreement and waive any objection to the convenience of any such court.

10.2

Any provision of this Agreement, which is prohibited or unenforceable, shall be ineffective only to the extent of such prohibition or unenforceability, without invalidating the remaining provisions hereof.

11. Indemnification/Release.

You agree to defend, indemnify and hold harmless Skyfleet Ltd, its respective directors, officers and employees from and against all claims and expenses, including attorneys’ fees, arising out of or related to any products or services purchased by you, or any Statements submitted or posted by you, in connection with the Site or any use of the Site in violation of these Terms.
